General Terms and Conditions

 

By placing an order in the webshop operating at www.erikadekanyart.com, you become a customer of Erika Dékány, sole trader (small taxpayer). By submitting your order and receiving its confirmation by e-mail from Erika Dékány (immediately but within a maximum of 48 hours), a distance contract is concluded between Erika Dékány, sole trader (registered office: 2483 Gárdony, Mészáros Lázár utca 7.; tax number: 91827735-1-27; phone number: +36-20-233-0690; e-mail: erikadekanyart@gmail.com) as the Seller, and the person placing the order as the Buyer, in accordance with Government Decree 45/2014. (II. 26.) on the detailed rules of contracts between consumers and businesses.

Please read these General Terms and Conditions (hereinafter: GTC) carefully. If you wish to become a customer or active user of the webshop, please use the services only if you agree with all the terms and accept them as binding.

By browsing the webshop and submitting your order, you accept the General Terms and Conditions and the data processing principles.

This document is not filed, is concluded exclusively in electronic form, and cannot be retrieved later. It does not refer to any code of conduct.

The Buyer

According to Act XIII of 2022 on the itemized tax of small taxpayers, Section 5. § (1) g), only private individuals (including private individuals with a tax number and agricultural producers) may place orders and purchase products in the webshop.

 

Description of the Products Available for Purchase

Products displayed in the webshop can be purchased online with home delivery or personal pickup at the pickup point at a pre-arranged time.

The webshop offers hand-painted paintings created by the Seller, available from stock. Additionally, art prints and photo wallpapers based on selected paintings can also be ordered.

Customers may also order custom hand-painted paintings, which are created according to the customer’s requirements regarding price, size, and color scheme, agreed in advance.

 

Prices

Prices displayed in the webshop are gross selling prices, but do not include shipping costs. The right to change prices is reserved.

In exceptional cases, due to a database error, a product may appear with an unreasonably low price. In such cases, the webshop is not obliged to supply the product at the incorrect price and will contact the Buyer immediately after identifying the error.

 

Product Photos

Photos displayed in the webshop are illustrative. The colors seen on screen may differ from the actual colors of the painting due to display settings. Differences between the colors in the photos and the actual product do not qualify as defective performance.

 

Purchasing Process

1. Registration

Purchases can be made with or without registration.

For purchases without registration, the data provided by the Buyer (name, billing address, shipping address, e-mail, phone number) are stored by the system for 12 months, after which they are automatically deleted. The purchase option without registration can be selected by clicking the "Send" button after adding the products to the cart and selecting the quantity you wish to order.

New customers can register by clicking “Registration”. During registration the customer must provide: name, e-mail address, optional phone number and password. The system will confirm successful registration in a window. Registered users can log in with their e-mail and password. Personal data can be modified at any time. Registration can also be deleted upon request. The advantage of registration is that previous purchases are stored for 12 months, and shipping/contact data do not need to be entered again.

 

2. Selecting a Product

Customers can browse the webshop products and view detailed descriptions. To purchase a product, click “Add to cart”. In the cart, customers can check: selected products, quantities, and prices. They can modify quantities or continue shopping.

 

3. Entering Personal Data

Customers must enter the necessary personal details required for order processing.

 

4. Entering Billing Data

Customers must provide billing information required for issuing an invoice.

 

5. Selecting a Payment Method

Bank Transfer

If home delivery is requested, the shipping fee will be calculated after the order. An invoice will be issued including the product price and shipping cost and sent by e-mail. After the payment arrives in the Seller’s bank account, shipment will be arranged immediately. The original invoice will be included in the package.

Cash Payment

If personal pickup is selected, the Buyer can collect the product at the pickup point at a pre-arranged time and pay in cash upon collection. The Buyer receives the original copy of the invoice at the pickup point.

 

Notice Regarding Package Delivery

If a package is returned due to non-acceptance, the shipping cost will be charged to the Buyer.

 

6. Delivery Method

Home Delivery

If the shipping address differs from the billing address, it can be specified here. Shipping costs include packaging costs. All shipments are insured.

Delivery is carried out by:

  • DPD Hungary Kft.
  • GLS General Logistics Systems Hungary Csomag-Logisztikai Kft.

Personal Pickup

No shipping or packaging costs apply. The purchased product can be collected personally at the pickup point at a pre-arranged time. In case of personal collection of the package, the purchase price must be paid in cash on site at the time of collection.

 

7. Product price

The price of the product(s) listed on the order, the total line only includes the price of the selected product(s), not the delivery fee. The delivery fee will be determined later.

 

8. Finalizing the order (making an offer)

If you are sure that the contents of the basket correspond to the products you want to order and that your details are correct, you can finalize your order by clicking the "Send" button. The information provided on the website does not constitute an offer to conclude a contract by the Seller. In the case of orders subject to these GTC, you are considered the offeror, and the contract is concluded upon the Seller's acceptance of the offer you made via the website in accordance with the provisions of these GTC.

By pressing the "Send" button, you expressly acknowledge that your offer shall be deemed to have been made and that your statement - if confirmed by the Seller in accordance with these GTC - entails a payment obligation. You are bound by your offer for a period of 48 hours. If your offer is not confirmed by the Seller within 48 hours in accordance with these GTC, you are released from your offer.

 

9. Order processing, conclusion of the contract

You will first receive a confirmation of your order, which only records the fact that your order has been received via the website, but this confirmation does not constitute acceptance of your offer. If you notice that your data is incorrect (e.g. name, delivery address, telephone number, etc.), you are obliged to notify me of this fact immediately - at the same time as providing the correct data by sending an e-mail to my e-mail address erikadekanyart@gmail.com. After that, you will receive an automatic confirmation e-mail about your order within 10 minutes of placing your order. If you do not receive the automatic confirmation e-mail, please contact me, as it is possible that your order did not arrive in the system for technical reasons.

The contract is concluded upon acceptance of your offer by the Seller (automatic confirmation email).

 

10. Finalizing the order

The webshop will send you the payment request by e-mail, which already includes the total amount of the order (i.e. the purchase price of all ordered products and the shipping fee incurred).

The bank transfer should be made to the CIB Bank account number 10700079-11587503-53300005 in my name, please indicate the order number in the confirmation e-mail in the message. The ordered product cannot be delivered by courier before the total amount has been received.

 

11. Order fulfillment

Home delivery

Home delivery is carried out by the following companies: DPD Hungary Kft., or GLS General Logistics Systems Hungary Csomag-Logisztikai Kft.

I ask that you inspect the package in front of the courier upon delivery, and in case of damage to the package, request a report and take possession of the goods item by item. I ask that you check not only the package but also the integrity of the products inside it on site, and also check the quantity of the products, since in case of damage or deficiency, it must be recorded in a report. If the packaging or product is visibly damaged, the Buyer is obliged to draw up a report with the courier. In the absence of a report, I cannot accept complaints regarding physical damage resulting from transport!

Personal receipt

You will not be charged for separate transport and packaging costs. You can pick up the ordered product in person at the collection point, at a pre-arranged time. In case of personal collection of the package, the purchase price must be paid in cash on site at the time of collection; payment by bank card is not possible.

Delivery Time

The general delivery time is 10 working days from order confirmation.  This delivery time is indicative. Any deviation will be communicated via e-mail. By accepting these GTC, the Buyer acknowledges that the Seller excludes liability for damages resulting from delays exceeding the estimated delivery time.

 

Right of withdrawal

According to Section 20 of Government Decree 45/2014. (II. 26.) on the detailed rules of contracts between consumers and businesses (hereinafter: Government Decree), the Buyer may withdraw from the contract without giving any reason within 14 days of receipt of the purchased product in stock and return the purchased product. The cost of return shipping is borne by the Buyer. The product can be returned within 14 days after indicating the intention to withdraw. The web store complies with its obligation to provide information pursuant to Section 18 of the Government Decree by sending an email (automatically within 48 hours) confirming receipt of the order. Please familiarize yourself with the content of the information and then keep it.

The Buyer has the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you or a third party other than the carrier indicated by you acquires possession of the last product. If you wish to exercise your right of withdrawal, you must send a clear statement of your intention to withdraw (for example, by email, by telephone or by post to the contact details provided in the Operator Data). You may also use the attached withdrawal form for this purpose.

You exercise your right of withdrawal within the deadline if you send your withdrawal declaration before the expiry of the deadline specified above. We will immediately confirm the receipt of the withdrawal on a durable medium (electronic mail).

In the event of exercising the right of withdrawal, the Buyer shall not be charged any other costs than the cost of returning the product, however, the Seller may demand compensation for material damage resulting from improper use.

Please contact the web store before returning the product. The costs incurred in connection with the return of the product shall be borne by the Buyer. If you return a product to the web store for which you cannot exercise your right of withdrawal, the purchase price will not be refunded.

In the event of exercising the right of withdrawal, please return the product to the web store in its original, undamaged condition, with all packaging elements. The Buyer may be obliged to compensate for damage resulting from improper use. The web store will refund the full purchase price only if the product is returned undamaged. After the return of the undamaged product, the web store will refund the amount paid by the Buyer to the Buyer immediately, but no later than within 14 days, in accordance with the Government Decree.

Pursuant to Section 29 (1) c) of the Government Decree, the Buyer is not entitled to the right of withdrawal in the event that he has purchased a painting that was produced specifically at his request, order, based on his requirements, in accordance with his individual request, and the Buyer is not entitled to the right of withdrawal in the event that the Buyer has ordered a photo wallpaper or an art print in a custom size.

 

Legal effect of withdrawal

If you withdraw from this contract, I will refund the purchase price you have paid, including the delivery costs (except for the additional costs incurred because you chose a method of transport other than the cheapest standard method of transport offered by me), without undue delay and at the latest within 14 days of receipt of your notification of withdrawal. You will bear the cost of returning the product.

For the refund, I will use the same payment method as the one used for the original transaction, unless you have expressly consented to the use of a different payment method; you will not incur any additional costs as a result of using this method of return.

I may withhold the refund until I have received the undamaged product back, or until you have provided proof that you have returned it undamaged, whichever is the earlier. You must return or hand over the product to me without undue delay and at the latest within 14 days of communicating your withdrawal. The deadline is met if you send the product back before the 14-day deadline has expired.

Procedure for exercising the right of withdrawal

If – in accordance with the above – you wish to exercise your right of withdrawal, you can notify us in writing or by telephone at one of the contact details provided. You can exercise your right of withdrawal by making a declaration of withdrawal. When notifying us in writing by post, I will take into account the date of posting, in which case you must send your declaration of withdrawal as a registered mail, so that you can prove the date of posting. Return the ordered product in its original, undamaged condition to the address of the collection point in person, by post or by courier. It is important that the costs incurred in connection with the return of the product are borne by the Buyer, the webshop is unable to accept packages sent by cash on delivery! Pay particular attention to the integrity of the product, as compensation for damage resulting from improper use is borne by the Buyer!

After the package arrives at the collection point, the opening of the package and the inspection of the returned product will be recorded with a camera. This is necessary to avoid any misunderstandings that may arise later (for example, that the returned product was damaged or incomplete). The web store will refund the purchase price of the product to the bank account number provided by the Buyer (purchase in the web store is also possible upon agreement).

 

Complaint Management

The aim of my website is to fulfill all orders in good quality and to the full satisfaction of the customer. If the Buyer has any complaints regarding the contract or its fulfillment, he/she can also report his/her complaint by phone or e-mail.

I will immediately examine the oral complaint and take the necessary measures. If the Buyer does not agree with the handling of the complaint or if an immediate investigation of the complaint is not possible, I will record the complaint and my position on it. I will respond to the written complaint in writing within 5 days. In the event of a position rejecting the complaint, I will justify my response.

I would like to inform you that if your complaint is rejected, you may initiate an official procedure or turn to a conciliation board.

The Seller will turn to a conciliation board in order to resolve the consumer dispute.

The conciliation body is responsible for attempting to reach an agreement between the parties in order to settle the consumer dispute, and if this fails, it will make a decision on the case in order to ensure the simple, fast, efficient and cost-effective enforcement of consumer rights.

At the request of the consumer or the service provider, the conciliation body provides advice on the rights and obligations of the consumer.

In the event of a cross-border consumer dispute related to an online purchase or service contract, the mediation body operating under the Budapest Chamber of Commerce and Industry is solely competent for the procedure.

In accordance with Section 1 (1) of the Copyright Act of 1999 (hereinafter referred to as the Copyright Act), the website is considered a work of authorship, and therefore all parts of it are protected by copyright. Pursuant to Section 16 (1) of the Copyright Act, the unauthorized use of graphic and software solutions, computer programs on the website, or the use of any application with which the website or any part of it can be modified is prohibited.

All content, images, photos, and text on the erikadekanyart.com website are the property of Erika Dékány, and their use in whole or in part requires written permission. Any material may be taken from the website and its database only with the written consent of the copyright holder, with a reference to the website and indication of the source.

 

Data management

When using the webshop, I will treat the personal data provided confidentially and will not disclose it to third parties, except if it is necessary for delivery or home delivery. While browsing the webshop, technical information will be recorded for statistical purposes. To use the service, cookies must be enabled. If you do not want to allow the use of cookies, you can disable them in your browser settings. If cookies are disabled, certain elements of the service can only be used partially or not at all. No personal data will be stored in the cookie.

I will use the data recorded during the order to fulfill the order. The data will be automatically stored by the system for 12 months, after which it will be deleted. The invoice data generated by the individual IT systems from the order placed on the webshop pages will be recorded and stored with the data provided during the order placement for the period specified in the applicable accounting law.

You can request the deletion or modification of your data at any time by sending an e-mail to erikadekanyart@gmail.com.

In matters not regulated in these General Terms and Conditions, the provisions of the Hungarian Civil Code, Government Decree 17/1999. (II. 5.) on contracts concluded between distant parties, and Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information society shall govern.
